There have been recent changes made to the UK Border Agency's (UKBA) Family Returns Process. This is likely to lead to an increase in requests for information sharing between UKBA and Local Authorities (LAs). These requests will be made by the UKBA in order to fulfil its statutory duty to safeguard and promote the welfare of children when managing the returns process for families with children, who have no lawful right to remain in the UK and against whom the UKBA is taking action. The letter outlines the context within which such requests will be made and the way in which any information received in response to such requests will be managed. Shared information should ensure that, in relation to a return plan for a particular family, the UKBA takes account of any information held by other agencies that relates to safeguarding, welfare or child protection.

Status: Case-law - Court of Appeal judgment given on 10 November 2011

The local authority had appealed against a decision that a child living with a grandparent in an arrangement initiated by the authority, was a 'looked after' child and thus that the grandparent was entitled to financial provision from the authority in the form of a full fostering allowance.
